Terms of Use

1. Who we are and what these terms cover

Viralize Shop is operated by [COMPANY NAME], CNPJ [CNPJ] ("we"). These Terms govern the use of the platform that turns product photos into advertising videos generated by artificial intelligence.

By creating an account or using the service, you confirm that you have read and agree to these Terms and to the Privacy Policy. If you do not agree, do not use the platform.

2. Who can use it

• You must be 18 or older and have full legal capacity.
• If you use the platform on behalf of a company, you confirm you have the authority to bind it to these Terms.
• You are responsible for keeping your password confidential and for all activity on your account.

3. How credits work

• The service is charged in credits. One hundred credits equal one second of generated video.
• Each plan grants an amount of credits per monthly cycle, refilled on renewal. Plans purchased earlier under other conditions (such as Lifetime) keep the conditions under which they were purchased.
• The number of videos you can produce depends on the length you choose: the same allowance yields more short videos or fewer long ones.
• Unused plan credits do not roll over to the next cycle, unless expressly stated otherwise.
• Extra credits bought in packs do not expire while your account is active.
• If a video generation fails because of an error on our side or the artificial intelligence provider's side, the corresponding credits are automatically returned to your account.

4. Payment, renewal and cancellation

• Subscriptions are charged by card, in US dollars, and renew automatically at the end of each monthly cycle, at the current price, until you cancel. Your card issuer may apply currency conversion or international transaction fees.
• Extra credit packs are one-time charges, with no automatic renewal. Access purchased earlier via Pix lasts for the period that was paid for.
• You can cancel the renewal at any time from your account. Cancelling stops future charges and access remains until the end of the period already paid, with no prorated refund.
• We may change prices and plan composition. Changes do not affect cycles already paid and will be communicated reasonably in advance of the next renewal.
• Non-payment may suspend access to paid features.

5. Right of withdrawal

Because this is a purchase made outside a physical store, you may withdraw from the purchase within 7 (seven) calendar days of contracting, under article 49 of the Brazilian Consumer Protection Code, by requesting a refund through our contact channel.

Since the service is delivered immediately and each generated video has an irreversible processing cost, the refunded amount may be reduced in proportion to the credits actually used in the period. If you have not generated any video, the refund is full.

6. Content you upload and your warranties

You remain the owner of the photos and information you upload. By uploading them, you grant us a limited, non-exclusive and revocable license to store and process that content, including sending it to artificial intelligence providers, for the sole purpose of generating the videos you requested.

By uploading a photo, you represent and warrant that:

• You hold all necessary rights to the image, including copyright and commercial use rights.
• If the image contains identifiable people, you have obtained their express consent to use and modify the image for advertising purposes.
• The image does not depict children or adolescents.
• The image does not contain nudity, sexual content, violence, hate speech, illegal activity or material that infringes third-party rights.
• The advertised product is lawful and can be sold in Brazil.

7. How artificial intelligence handles your photo

Videos are generated by third-party artificial intelligence models. This has practical consequences you need to know before you buy:

• The result is probabilistic. We do not guarantee exact fidelity to the product, absence of visual distortions, or any commercial performance, reach or sales resulting from the use of the videos.
• Providers apply their own content filters and may reject certain images, especially those containing faces or visible personal data.
• When an image is rejected by these filters, we may automatically generate an alternative, sanitized version of the product photo and use it to produce the video, replacing the original image in your catalog. This is done so the generation does not fail. If you prefer this not to happen, let us know through the contact channel.
• You are responsible for reviewing the video before publishing it or using it in campaigns.

8. Rights to generated videos

Subject to these Terms and payment of the amounts due, you may use the videos generated from your photos commercially, including in paid ads and on social media.

We may show videos generated on the platform as public examples on our website and in promotional materials. If you do not want yours to appear, just let us know and we will remove it.

9. Prohibited uses

Breach may lead to suspension or termination of the account, without refund of amounts already used, without prejudice to applicable legal measures.

• Uploading third-party content without authorization or that infringes image, trademark or copyright.
• Generating misleading, defamatory or discriminatory material, or material that simulates a real person's endorsement without authorization.
• Advertising prohibited, counterfeit or illegal products.
• Trying to bypass credit limits, creating multiple accounts to obtain repeated free trials, or exploiting system flaws.
• Reverse engineering, automated scraping or intentionally overloading the platform.

10. Service availability

We work to keep the platform available, but we do not guarantee uninterrupted operation. The service depends on external infrastructure, payment and artificial intelligence providers, and may be interrupted by maintenance, third-party failures or events beyond our control. These Terms do not offer a contractual uptime guarantee (SLA).

11. Limitation of liability

To the maximum extent permitted by applicable law, and without prejudice to the rights guaranteed to consumers by the Brazilian Consumer Protection Code, our liability for losses related to the use of the platform is limited to the amount you paid in the 12 months before the event.

We are not liable for lost profits, loss of business opportunity, performance of advertising campaigns, decisions by ad platforms about your content, or misuse of the videos by you or third parties.

12. Termination

You can close your account at any time. We may terminate or suspend accounts in case of breach of these Terms, fraud, security risk or legal requirement. After termination, content is removed according to the timeframes described in the Privacy Policy.

13. Changes to these Terms

We may change these Terms at any time. The last-updated date at the top of this page shows the current version, and relevant changes will be communicated. Continued use after notice means you accept the new version.

14. Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of [DISTRICT/STATE] are chosen to settle disputes, without prejudice to the consumer's right to file in the courts of their own domicile.
